TERMS & CONDITIONS OF STAY

DEFINITIONS
For the purpose of these Terms and Conditions of stay, the following definitions shall mean:
“Hotel” : means Ubertas Hotel Management Pty Ltd [ABN: 60105474967] and accommodation delivered by Papercove Pty Ltd ATFT Dadon Number 4 Property Trust [ABN: 37938793377] managing under the brands Mercure and Naima
“Guest” : means the guest or guests present in the Hotel under one booking. Guest includes Invitee for which the Guest has full responsibility.
“Invitee” : is covered under these terms and is full responsibility of the Guest.
“Apartment” : means the Hotel room or apartment allocated to the Guest under the booking.
“Booking” : is any reservation made for or by the Guest to occupy one or several apartments.
“Hotel Car Park” : means car park managed by the Hotel.
- IDENTIFICATION
By checking into the Hotel, the Guest agrees to provide the following:- (i) a valid International or Australian Federal or State government issued photographic ID upon check-in to the hotel; and
(ii) a valid credit card in the name of the photographic ID to be used by the Hotel for pre-authorisation and payment purposes.

- ACCOMMODATION CHARGES
- (i) All accommodation charges must be settled upon check-in. This excludes permanent chargeback accounts.
(ii) All credit card payments incur a credit card surcharge for Visa, Mastercard is 1.5% and 3.5% for Diners, AMEX.

- PRE–AUTHORISATION
- (i) A bond for the amount of AUD$100 will be placed on the credit card of the Guest. The bond acts as a damage & extra charge deposit to cover any incidental items including, but not limited to, telephone calls, breakages, damage, additional cleaning charges, etc. This pre-authorisation will be refunded on the day of check-out subject to the final inspection of the guest room.
(ii) If the expenses incurred by the guest during the stay exceed the $100 bond, the guest hereby authorises the Hotel to charge any additional amount to match the incurred expense.
(iii) By signing this registration card, the Guest understands that this authorisation may be used to cover accommodation and any incidental costs that may occur during his or her stay.
(iv) The bond amount will be reimbursed to the guest after check-out after a final inspection of the room is made. The time it takes for financial institutions to release the funds varies. You should check with your credit card issuer if the delay exceeds 10 days. The Hotel takes no responsibility for delays outside its control. Proof of release of funds can be provided upon request.

- CAR PARK
Upon booking, prior to and during the use of the carpark, the Guest will:- (i) provide the registration number plate of the vehicle to the Hotel upon booking the car park.
(ii) notify the Hotel of any changes to his or her vehicle or number plate for the duration of using the car park.
(iii) be required to urgently remove his or her vehicle upon request by the Hotel in which case the Guest will be refunded monies paid for days of the carpark paid but not used.
(iv) accept no refunds will be payable to the Guest if the Guest does not use the car park on his or her own accord; and
(v) pay for any damage to the car park caused by the Guest to the Hotel.
(vi) car park rent is $40 per day.
- (i) provide the registration number plate of the vehicle to the Hotel upon booking the car park.
- CONDUCT
- (i) Guests and Invitees are required to behave in a manner which is conducive to the safety, comfort and convenience of other guests and residents within the property.
(ii) The by-laws of the complex and any reasonable direction of the Manager on Duty must be complied with by the Guest and Invitee. A breach of rules may result in eviction of the Guest at the discretion of Hotel Management.
(iii) There is a strict NO PARTY POLICY which will be enforced.
(iv) The apartment must not be used for any unlawful purposes.
- (i) Guests and Invitees are required to behave in a manner which is conducive to the safety, comfort and convenience of other guests and residents within the property.
- LOSS OR DAMAGE
- (i) The Hotel shall not be liable to any Guest for any loss, damage or destruction to any property brought upon these premises by the Guest or Invitees. Without limiting the foregoing, personal property shall include, but is not limited to, money, jewellery, and other personal effects.

- GYM
- (i) The Guest agrees to take full responsibility for the use of the gym and its equipment. The Hotel shall not be liable in the case of any accident that may occur due to the Guest using the gym and/or its equipment.
(ii) The Guest hereby will indemnify the Hotel of any costs that may be incurred resulting of such accident or incident.
(iii) No Invitee or person under the age of 16 is permitted to use the gym. Persons aged 16 and 17 must be
accompanied by an adult.
- (i) The Guest agrees to take full responsibility for the use of the gym and its equipment. The Hotel shall not be liable in the case of any accident that may occur due to the Guest using the gym and/or its equipment.
- SMOKING POLICY
- (i) Evidence of smoking in the complex or common areas may result in additional cleaning charges payable by the Guest or Invitee and eviction from the Hotel.
(ii) Smoking is permitted on the apartment balcony with the balcony door closed. Smoke must not enter the apartment.

- PETS
- (i) Unless otherwise agreed by the Hotel Manager, no animals or pets are allowed.
(ii) Guide dogs are accepted for the vision and mobility impaired guests.

- FIRE ALARM
- (i) A Guest or Invitee found to have activated a fire alarm without due cause, resulting in the call out/attendance of the Fire Department will be deemed liable for the payment of any Fire Brigade charges, and all associated fees as a result of a false alarm.
- CHECK IN AND CHECK OUT TIMES
- (i) The check in time is from 2:00 pm on the day of arrival.
(ii) The check-out time is 10.00 am on the date of departure.
(iii) Late check-out prior to 12:00 pm can be requested by the Guest and may be granted at the discretion of hotel management, subject to availability
(iv) Late check-out request must be authorised by the hotel Manager on Duty to avoid additional charges.
(v) Check-out after 12:00 pm midday and before 2:00pm incurs charges of 50 per cent of the daily rate.
(vi) Check-out after 2:00 pm incurs a full charge of the daily rate.
(vii) The check in time for same-day bookings made after 2:00 pm is from 6:00 pm on the day of arrival.

- MINI BAR
- (i) The mini bar can be restocked by scanning the QR code located on the mini bar fridge in the room. Charges for the mini bar items will be incurred through this QR code system. Please note, any personal items left in the mini bar by the guest will be removed and discarded.

- OTHER CHARGES
- (i) The Guest shall be responsible for all charges including accommodation costs, additional expenses, item replacements and necessary costs for any damage or loss to the apartment.
(ii) Failure to pay the account will result in penalty interest of 25% being charged and a claim for outstanding debts under the jurisdiction of appropriate courts in all Australian States and Territories.
(iii) The Guest is personally liable for payment of the account and agrees that any additional charges for services not billed by the time of departure will be added to his or her account for settlement.
- (i) The Guest shall be responsible for all charges including accommodation costs, additional expenses, item replacements and necessary costs for any damage or loss to the apartment.
- AMENDMENS AND CANCELLATIONS
- (i) If an “amendment or cancellation” of the booking occurs at any time during the course of stay or prior to the check-in, the Guest will be liable for the payment of any cancellation or amendment fees which may apply.
(ii) No refunds will be given for early departures, cancelled nights or accommodation changes after the guest has checked in.
(iii) The Hotel reserves the right to refuse service or accommodation or to remove a guest if behaviour is deemed inappropriate by Hotel Management.

- PRIVACY
- (i) The Guest acknowledges that they have read and understood the Privacy Policy of the Hotel as published on our website. The Guest consents to the collection, use and disclosure of their personal information by the Hotel for the purposes outlined in the Privacy Policy.

- DISPUTE RESOLUTION
- (i) The Guest agrees that any dispute resolution that incurs any costs for the Hotel will be covered by the Guest, including any charges from credit cards incurred for any dispute.
(ii) The Hotel reserves the right to charge the Guest for these costs and the Guest agrees to pay them.
(iii) If the dispute cannot be resolved, the matter should be brought to VCAT or the Small Claim Tribunal by either the Guest or the Hotel.
- (i) The Guest agrees that any dispute resolution that incurs any costs for the Hotel will be covered by the Guest, including any charges from credit cards incurred for any dispute.
- FORCE MAJEURE
- The Hotel will not be in breach of the agreement or any way liable to any party, if it is prevented from complying with this agreement by reason of act of God, act of public enemy, act of terrorism, war, earthquake, riot, explosion, compliance and with any law or government restraint order, rule regulations, strikes, lockouts or any other cause not reasonably within the control of the Hotel.

- GOVERNING LAW
- These Terms and Conditions will be governed by and construed in accordance with the laws of the State of Victoria, Australia, and each party agrees to submit to the exclusive jurisdiction of the courts of the State of Victoria, Australia.

- ACKNOWLEDGEMENT
- By signing the registration card, or completing the check-in process, the Guest acknowledges and agrees to be bound by these Terms and Conditions of stay.

- SEVERABILITY
- If any provision or part-provision of these Terms and Conditions is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of these Terms and
Conditions.

Ubertas Hotel Management reserves the right to amend these terms and conditions at any time and you should therefore check them each time you make a booking. The terms and conditions applying to your booking will be those in place on the date that you made your booking.
